LinksManager is a trade name under which LinksManager, LLC., does business relating to the LinksManager system. All users of the LinksManager system and service are required to agree to the following Terms and Conditions.  Anyone determined by LinksManager to have violated these terms and conditions is subject to service termination without any obligation by LinksManager LLC or it's parent company Creative NetVentures, Inc.

Exclusive Use
The LinksManager system is for the exclusive use of webmasters and web site managers.  The following types of sites are NOT PERMITTED to use the LinksManager system for any reason: Websites encouraging illegal activity or racism, sites providing instructions or discussions about performing illegal activities, sites engaged in libelous or harassing activities, sites that fail to publish or provide a clear means of communication (email address or form-mail), sites that promote or utilize software or services designed to deliver unsolicited email, sites that are otherwise inappropriate.  

By agreeing to these Terms, you understand and agree that LinksManager LLC., has the sole and exclusive right to limit the use of the LinksManager service and to permit or deny in its sole discretion the use thereof.


Pricing
Your LinksManager account can be used with one domain and is fully functional and includes all features for a base price of $29.95 per month per account (less than $1.00 a day!)*.  Pricing is based on how many link categories you use per month.  Categories and subcategories let you organize your links into meaningful groups.  A link category is seen on your links menu, and holds all of the links within it.  For example, an automotive website might have the following categories: car parts, car news, car enthusiasts, new car sales, used car sales.  Each category would contain links to other websites.  You are only charged for the link categories you use.  Each time you create a new category or subcategory, it counts as one category used.  There is no limit to the number of links you can have in each category or subcategory.  For most websites, up to 50 categories is more than enough categories to organize your links effectively.  For more information on link categories, see the LinksManager FAQ.

Pricing is on a sliding scale so that you only pay for categories you are using:  

LinksManager is free for the first 30 days.  After 30 days of trying the service, the base price is charged to your card according to the pricing schedule listed above.  However, you will not be charged if you refer at least one new user every month who completes a 30 day billing cycle.  You only need to refer 12 users per calendar year to receive the service for free year round.  Free service is credited to your account for each referral regardless of how many categories you have in use.  If you refer more than 12 users per calendar year, credits are applied to your account for future use and you will not pay for the service unless you stop referring users and your credits run out.  

Attempts to defraud LinksManager by referring accounts for the free credit and then canceling those referred accounts will result in account termination and blacklisting.

By agreeing to these terms and conditions, you hereby understand and agree that the account fee will be charged to your credit card every month.

Discount pricing for multiple accounts is published in the FAQ here.  For security reasons, discount pricing is not applied automatically since some webmasters use different card numbers for multiple accounts.  Requests for discount pricing must be made in writing via the helpdesk.  

Refunds
Please note:  NO retroactive refunds if you fail to ask for discount pricing.  No refunds for accounts that violates these Terms and Conditions. By agreeing to these Terms, you understand and agree that LinksManager LLC., does not provide refunds to accounts that violates these Terms and Conditions.  

Cancellation
You have the right to cancel at any time however please understand you must cancel in writing via your LinksManager account, simply click CANCEL ACCOUNT from the lower left account management options, or cancel in writing via our corporate sales contact form, or call the billing number on your card statement.  Cancellation in writing is for the security of all parties.  In the event that a billing dispute arises, activity logs and email archives allow us to research and resolve disputes promptly.  

Prorated credits are issued accordingly.  By agreeing to these terms and conditions, you hereby understand that LinksManager does not provide refunds except in the event that a credit is due at time of cancellation for that current month's service.  

By agreeing to these terms and conditions, you hereby understand that your account will be terminated resulting in loss of data (links) if your account goes unpaid for 30 or more days.

Any user issuing chargebacks against LinksManager is subject to immediate account termination without warning.

Reactivation
You have the right to request reactivation of a closed account at any time.  CNVI retains the right to refuse reactivation.  Reactivation fee is $9.95 for accounts that are self-closed prior, or closed by staff for editorial reasons. Reactivation fee is $19.95 for accounts that are closed for no payment. You will also be charged for the first month of service back with LinksManager when reactivating.  Please note:  Each domain may receive ONE lifetime 30 day trial.  No duplicate free trials are permitted at reactivation.  BY agreeing to these Terms and Conditions, you agree and understand that reactivation fees are strictly non refundable.

Termination for Non Payment
Accounts that go into arrears (non payment) for more than 30 days are subject to termination and removal of your links pages from your server without notice. LinksManager will send you email advising you if your account has been suspended for non payment. Accounts that go over 30 days for non payment are subject to termination without further notice.

Ownership and Rights
LinksManager LLC retains ownership and all rights to the LinksManager name, logo, software, web site, all data, and related proprietary information.  LinksManager users may not use the LinksManager name or or logo or any confusingly similar variations or modifications for monetary gain or profit outside of the rights outlined in this agreement.

Liability
The LinksManager system is protected from network outages with redundant T3 connectivity to the internet, and is protected from power outages with electric generators and other backup systems.  Although we will make a reasonable effort to provide a very high standard of quality for our services, no guarantees of any kind regarding the dependability or timeliness of the services of LinksManager can be made and are not being made.  All users agree to utilize the LinksManager services at their own risk.  It is specifically agreed that LinksManager LLC., or the LinksManager system administrators, partners and sponsors may not be held liable for any damage to or loss of data or any information that may occur from the use of the the LinksManager system or services.  

Intellectual Property
The information provided to users of the LinksManager system may be proprietary in nature.  Users of the LinksManager system and service acknowledge that they are not competitors of LinksManager, and agree not to share this information with any competitors of the LinksManager system.  The LinksManager service is a patented system.  Anyone misappropriating or copying intellectual property from this website will be prosecuted to the fullest extent of international law. 

Indemnification
As a user of the LinksManager system you hereby agree to defend, indemnify and hold LinksManager LLC and it's parent company Creative NetVentures, Inc. harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys' fees) arising from your violation of this Agreement or any third-party's rights, including but not limited to infringement of any copyright, violation of any proprietary right and invasion of any privacy rights.  This obligation will survive any termination of this Agreement.

Proper Use

The quality of the LinksManager brand and product is directly related to the websites that utilize our service.  For this reason, all users must read and agree to the following Terms and Conditions before registering for LinksManager.  If you are unable to agree to the Terms and Conditions below, you will not be able to utilize a LinksManager account.  If you agree to the Guidelines, Terms and Conditions below, and at a later time do not follow these guidelines, your account will be terminated or suspended without notice.

LinksManager is intended for management of links pages, resource pages, or search engine type style directories.  The guidelines below ensure the best usage of LinksManager and our sister site LinkPartners.com, help you maintain a quality website, and show that you are engaged in ethical website promotion.

Myself or my account representatives understand that setting up links pages, resource pages, or search engine style directories should be for the benefit of your website visitors, not for the search engines. Using LinksManager to create pages intended solely for link popularity or tricking the search engines into higher rankings will result in account suspension or termination without notice.

Myself or my account representatives understand that link categories and the links that appear within should be relevant to my own website's theme, genre, or focus. We understand that swapping links with a few quality, relevant websites has more value to our users than swapping links with hundreds of irrelevant websites. Setting up link categories and/or swapping links not directly related to our own website's theme, genre, or focus can result in account suspension or termination without notice.

Myself or my account representatives understand that whether or not a website will reciprocate our link is not a good determination of that website's value. We understand the value of a link is determined by the relevancy of the website to our own website visitors.  


* Some import features are limited during the free trial for security and abuse prevention reasons.  Contact the Helpdesk if you encounter any "trial limit" warnings and request removal of any security limits you reach for your account.
